The artworks and services offered are those listed on Bouillon d’art’s website.

These artworks and services are offered within the limit of available stocks. Each artwork is accompanied by a photography and a descriptive text made by the gallery.

The prices listed on this site are indicated in € or $ - all taxes included – excluding delivery charges. The ordered artworks are invoiced at the price in effect at the time of the registration of the order.

For an outside of Metropolitan France order: you are the importer of the concerned artwork.

Pour the shipping outside the European Union, taxes may be due.

These taxes are not our responsibility and are not billed by Bouillon d’art. They will be at your expense and are entirely your responsibility, both in terms of statements and payments to the authorities and/or bodies of your country.

Artworks remain the entire property of Bouillon d’art until full payment of the indicated price.

When you confirm your order by clicking on the « validate information » button, you declare to have acquainted and have accepted the entirety of these general conditions of sale.

Upon registration of your order, an acknowledgment will be sent to you by email after validation of payment.

We reserve ourselves the right to cancel any order from a customer with whom we would have had a dispute concerning the payment of a previous order.

The contract is concluded upon the confirmation of the payment by the bank.

5.    Payment

The payment of your purchases can be made in € or $. There are several possible means of payment.

•    By credit card, it is possible to choose payment by credit card in 3 times, free of expenses: it is done online during your order. You card details are encrypted during the transaction (SSL mode, Secure Socket Layer) and 3D secure, the best performing payment system, that establish an encrypted connection directly between the buyer and the bank. Bouillon d’art has in no way access to confidential information relating to the means of payment that the customer uses during the payment. This is why the customer’s bank details will be requested for each new order.

If you choose to pay by money transfer, your order is reserved for 5 working days. It will then be shipped at the reception of the money transfer.

Although Bouillon d’art uses encrypted security software, the security of information and payments transmitted over the internet or via e-mail can not be guaranteed. Bouillon d’art can not be held responsible for damages resulting from the use of electronic ways of communications, including (but not limited to) damage resulting from failure or delay in transmission of electronic communications, the interception or manipulation of electronic communications by third parties or by computer programs used for electronic communications and for the transmission of viruses.

6.    Delivery

Orders placed before midnight (Paris time, GMT +1h), Sunday to Monday, excluding holidays, are shipped within 3 days. The delivery time after shipping is 2 to 5 working days in France, and 4 to 10 working days for other destinations. This time period may vary depending on the country of destination and the method of delivery chosen. Delivery will be made to the address you specified on the order form. Bouillon d’art will not be liable in case of non-execution of the contract concluded due to reasons beyond our control especially in event of force majeure, disruption or strike of postal services and means of transportation and / or communication.

The transfer of risks concerning purchased artworks takes place as soon as they are handed over by Bouillon d’art to the carrier. Artworks are insured for their values during transport.

Reservations on reception of artworks

It is up to you, in case of negligence or of average, to emit precise and detailed notes to the carrier, by creating the mention Under Reserve on the shipping note, to benefit the contracted insurance. It is necessary to transmit the damage list to Bouillon d’art no later than 72 hours after delivery and a copy of the voucher indicating the reservations.

In the event of a gallery pick up, the buyer must pick up the artwork within 30 days. After this period of time, the gallery is no longer responsible for damages or theft of the artwork, which will then be under the buyer’s responsibility. After 6 months, the artwork will be considered acquired by the gallery, and no claim or refund will be accepted.

7.    Right of retraction – online refunds only

In accordance with the legal provisions in force, as part of a purchase made from a professional seller established in the European Economic Area (member countries of the European Union as well as Iceland, Norway and Liechtenstein), the Buyer, if he himself is a national of this zone, has a time period of 14 days from receipts of the product ordered to exercise, to the said Seller, his right of withdrawal, without having to justify reasons or to pay a penalty. The period of 14 days runs to the day of presentation of the artwork by the carrier to the address specified by the Buyer. The Buyer exercises his right to withdrawal directly to Bouillon d’art by an email at contact@bouillondart.com

Bouillon d’art will reimburse the Buyer for the price of the artwork as well as the shipping costs.

Refunds to the Buyer are made once the good reception of the artwork.

The artwork will have to returned in perfect conditions by the Buyer, in its original packaging (or equivalent).

Refund will be effective within 8 days upon the receipt of the artwork.

8.    Partial Invalidity

If any provisions of these Terms are held to be invalidated or declared such under any law, regulation or following a final a decision of a competent court, other provisions shall remain in full force and scope.

9.    Copyright and intellectual property

The artist remains the copyright owner. The rights of representation and reproduction of the artworks featured on www.bouillondart.com belong to their authors.  It is necessary to have their authorization for any exploitation of these rights. Elements of this website are protected under intellectual property laws, trademarks, and other copyrights. No reproduction and / or adaptation may be made without the authorization of Bouillon d’art.

10.    Rule of confidentiality

To place and order, you are required to provide us with certain information that will be subject to computer processing. By confirming your order, you allow us the processing of your file. In accordance with the law of January 6, 1978, you can access this information, ask for their modification or rectification or require to no longer appear in our database by sending us an email at : contact@bouillondart.com

The automated processing of information, including the management of e-mail addresses of users of the website has been declared to the CNIL on 22/07/2013 registered under number 1688995v0

11.    Applicable texts – Jurisdiction

This contract is subject to French law. In the event that a dispute should arise from this contractual relationship, the parties, Bouillon d’art and the buyer, agree before any legal action to seek and amicable solution. In case of dispute, you can go to the registry of the court closest to your home.
